I’m getting divorced, how much maintenance will I get?

Spousal maintenance after divorce is to be distinguished from maintenance for children. It is always preferable to settle all disputes... in a divorce but where parties have not entered into a written agreement, section 7(2) of the Divorce Act applies. It provides that the court may, having regard to the existing or prospective means of the parties, their earning capacities, financial needs and obligations, age, duration of the marriage, standard of living, conduct in so far as it may be relevant to the breakdown of the marriage, any order for redistribution of assets and any other relevant factor, make an order for payment of maintenance for any period until the death or remarriage of the party in whose favour the order is given, whichever event may first occur.

I’ve been married for 20 years, but my marriage is in trouble and I’m facing the very real possibility that... I may get divorced soon. My husband has a good pension that we’ve planned to use for our retirement, and I am worried that I will not be entitled to any share of that should we get divorced because we are married out of community of property with the accrual? Will this be the case?

As the world gets smaller and smaller, an ‘international wedding’ becomes a greater reality for many couples - from the... beach wedding in Mauritius to the castle wedding in Ireland or the Tuscan wedding in Italy. This international marriage or ‘traveller’s marriage’ may seem romantic, but can quickly turn sour when questions regarding the matrimonial property regime of the parties are raised at divorce or death of a party. Which legal regime governs the marriage: the country where they where married, the home country of a spouse, or the country in which the couple reside? Left in the air, the romantic traveller’s marriage could very well turn into a wearisome ball and chain!
