Level 2 Regulations Tougher on Evictions

In addition to elaborating on the conditions in terms of which restrictions on economic and other activity under Covid-19 lockdown level two may be relaxed, the new disaster management regulations list factors to be considered by a court when determining whether to ‘suspend or stay’ an eviction or demolition order until the end of the State of Disaster.

They also prescribe the situations in which terminating a rental housing agreement will be considered unfair practice until the State of Disaster is lifted. Gazetted and confirming President Cyril Ramaphosa’s announcement on 15 August, the new regulations nevertheless make no reference to inter-provincial travel. However, according to an accompanying departmental statement, ‘all restrictions on inter-provincial travel will be lifted’ effective 18 August, when ‘alert level two will
be in place’. Nightclubs are still not allowed to operate, despite the easing of restrictions on other liquor outlets.
